This policy (the "Privacy Policy") describes how Handshake AI Solutions, LLC ("Handshake AI", "we", "us", or "our") collects, uses, and shares your personal data in connection with your access and use of Handshake AI and the features therein, websites, including without limitation the ai.joinhandshake.com website (the "Handshake AI Site"), tools, data, and documentation (collectively the "Services"). By "personal data", "personal information" or similar terms, we mean any data relating to an identified or identifiable natural person that is processed by us in accordance with this Privacy Policy and that is subject to applicable data privacy laws.

The Privacy Policy applies to the Services. This Privacy Policy is part of Handshake AI's Terms of Service. By using the Services, you agree to both our Terms of Service and this Privacy Policy; if you do not agree, please do not use the Services. Unless otherwise stated, defined terms used in this Privacy Policy have the meanings associated with them in our Terms of Service.

This Privacy Policy was last updated on the date indicated above. We're constantly trying to make improvements to our Services, so we may need to change this Privacy Policy from time to time. If any changes are made, we'll post them on this page, so please be sure to check back periodically. When you continue to use the Services after changes have been posted, you are telling us that you agree to and accept the revised Privacy Policy.

Personal Data We Collect

In order to access the Services, you may be required to register for an account on the Handshake AI Site. If required to register for an account, you agree to register for and maintain an active user account on the Handshake AI Site (your "Account"). You may only possess one Account, and if it is suspended or terminated in accordance with the Terms of Service, you may not create another one unless you have explicit permission from Handshake AI to do so. You agree to maintain accurate, complete, and up-to-date information in your Account. In certain instances, you may be asked to provide proof of your identity to access or use the Handshake AI Site, and you agree that you may be denied access to or use of the Handshake AI Site if you refuse to provide such information or for any lawful reason as determined in Handshake AI's sole and exclusive discretion. To create and use your Account, you must be at least 18 years old. For more information on account creation, please review Handshake AI's Terms of Service.

  • Information You Provide. We collect personal data you provide to us when using the Services.
    • When you create an Account, we collect contact information such as first and last name, mailing address, phone number, and email address. We also collect username and password. You may have the option to provide additional information when creating your Account.
    • When you create an Account or apply for a contract position, you may be asked to provide additional information such as resume, transcript, compensation expectations, and desired start date.
    • Communications, Interviews, Transcripts or Recordings. We receive and store personal data when you choose to participate in a video or audio interview, meeting or call or meeting initiated through the Services or when you choose to communicate with other users by way of video, audio, or messaging during any video or audio conference or call (collectively, "Handshake AI Communications"). If you are selected to move forward in a specific application process, Handshake AI Communications may be in the form of an interview utilizing artificial intelligence ("AI") to facilitate such interview and pose questions related to the opportunity for which you are interviewing. By participating in Handshake AI Communications, you are giving Handshake AI consent to store the content and recordings of any Handshake AI Communications. For audio or video recordings, you will receive a notification (visual or otherwise) when recording is enabled (e.g., red indicator), and you should leave the meeting if you do not consent to being recorded. If we use a third-party video and/or communications service provider to facilitate Handshake AI Communications, that service provider may not use your personal data or the content of the communications for any purpose other than to provide the service to us.
    • Support, Feedback, and Other Communications. When you request information from us, respond to forms or questionnaires, participate in surveys, provide feedback, or otherwise contact us, we collect communications that we exchange with you which may contain personal data.
    • Marketing Data. Your preferences for receiving marketing communications and details about your engagement with such communications.
    • Chatbot Data. If you engage with any virtual chatbots or AI tool in connection with the Services, we will collect the information you provide during such interaction, including transcripts of your conversation.
  • Information Collected From Third Parties. If you choose to connect your Account to a separate account associated with a third-party service, we may receive or be granted access to information from such third-party service, including personal data. That third-party service may also gather certain information about you when you use our Services. You can generally control the information that we receive from third-party platforms, or the third-party's access to information, using the privacy controls provided to you by such third parties, or you may remove our access to that platform.

Information We Automatically Collect. To better understand how you interact with our Services, we and our third-party partners may use cookies, web beacons, pixels, tags, scripts, or other technologies to automatically collect certain information. Examples of the types of information are:

  • Log and Device Data. When you use the Services, we and our third-party partners may log certain information, such as IP address, device type and version, unique identifiers, cookie information, browser type and settings, mobile device carrier, network information, and general location information such as city, state, or geographic area.
  • Usage Data. When you use the Services, we collect certain information about your use, such as pages or screens you view, click, or otherwise interact with, how long you spent on a page or screen, navigation paths, and how and when you log into your Account.

How We Use Your Personal Data

We may use information that we collect about you, including personal data, as described below.

  • To Provide the Services. This includes operating, managing, maintaining, and/or personalizing our Services and business.
  • Communication. This includes communicating with you about the Services or other services you might be interested in, including by sending notifications, updates, alerts, announcements, or other messages, subject to your Account settings and communication preferences. You may opt out of receiving promotional communications at any time by clicking the unsubscribe link or updating your Account preferences.
  • Compliance and Protection. We may use your information to promote the safety and security of the Services, our users, and other parties. This may include responding to law enforcement requests, protecting against fraud or other illegal acts, complying with or enforcing our legal or contractual obligations and resolving disputes, and conducting audits.
  • Research and Development. We may, from time to time, research new ways to improve the Services or use information to better understand how the Services are being used or diagnose technical issues.
  • Marketing and Advertising. We may use personal data for marketing and advertising purposes, and where required under applicable law, we will only engage in such purposes with your consent.
  • Other. We may use your information to manage our business or perform functions as otherwise described to you at the time of collection, subject to your consent where legally required.

How We May Share Personal Data We Collect

There are limited circumstances in which we may share information, including personal data, with others, as set forth below:

  • Customers of Handshake AI. We may share information within your Account with an authorized agent of Handshake AI customers (each a “Handshake AI Customer”), including any audio or visual interview and transcription thereof, and also an AI-powered analysis of such information. Handshake AI Customers pay Handshake AI a fee in order to use Handshake AI Customer services.
  • Service Providers, Advisors, Consultants. We sometimes contract with third parties to assist us with providing the Services and communicating with you. Examples include cloud service providers, IT services and data management, Handshake AI Communications-related services, and other services for maintaining our systems. When we contract with others to perform functions of this nature, we only provide them with the information that they need to perform their specific function, and they are obligated to protect and secure your information.
  • Affiliates. We may share personal data with our corporate affiliates and subsidiaries, if any, for purposes consistent with this Privacy Policy.
  • Business Transfers. We may choose to buy or sell assets. In these types of transactions, personal data may be one of the transferred assets. We may share personal data with professional services, potential purchasers, or investors in connection with the sale, merger, consolidation, bankruptcy, transfer of assets, or reorganization of our company. We will notify you if a different company will receive your personal data, and this Privacy Policy will apply to your data as transferred to the new entity.
  • Legal Requirements. We may share personal data with relevant law enforcement bodies if we believe that disclosure is reasonably necessary to comply with a law, regulation, valid legal process (e.g., subpoenas or warrants served on us), or governmental or regulatory request; to enforce applicable terms in this Privacy Policy or the Terms of Service; to protect the security or integrity of the Services, and/or to protect the rights, property, or safety of Handshake AI, its employees, users, or others; to detect, prevent, or otherwise address security or technical issues, illegal, or suspected illegal activities (including fraud); or as evidence in litigation in which we are involved, as part of a judicial or regulatory proceeding. If we are going to release your data, we will do our best to provide you with notice in advance by email, unless we are prohibited by law from doing so.

Non-Personal Data. We may deidentify, aggregate, or anonymize data from the personal data you and others make available in connection with the Services such that you are not individually identified.

Storage, Security and How to Remove Your Information

We use industry standard technical, administrative, physical, and organizational measures to protect the data we collect, including encrypting it at rest and as it is transferred from you to us. While we take reasonable precautions against possible security breaches, no website or internet transmission is completely secure and we cannot guarantee that unauthorized access, hacking, data loss or other breach will never occur. In the event of a breach, we will take reasonable steps to investigate the situation and, where appropriate, notify affected individuals in accordance with any applicable laws and regulations.

You should also take steps to protect against unauthorized access to your device and account by, among other things, appropriately selecting your password, limiting access to your computer, device, and account, and signing off after you have finished accessing your Account.

We retain personal data for as long as reasonably necessary to provide you with the Services, to perform our legitimate business purposes, to comply with applicable law, and to prevent harm as described in this Privacy Policy.

You may request deactivation of your Account or deletion of your personal data by sending a message to move-support@joinhandshake.com.

Third-Party Links

The Services may contain links to and from third-party websites and applications, and any access to and use of such linked websites and applications is not governed by this Privacy Policy. If you follow a link to any of these websites or applications, please note your access to and use of the same is governed by their own privacy policies, and we do not accept any responsibility or liability for those policies or the practices set forth in them. Please check their individual policies before you submit any information to those websites.

Children and Minors

Minors under 18 are not permitted to use our Services. We do not intentionally collect information from minors under 13. If you believe we have collected any personal information from a child younger than 13 years of age, please notify us immediately here and we will take reasonable measures to remove that information from our systems.

Your California Privacy Rights

Effective Date: January 28, 2025

We adopt this notice at collection for California residents to supplement the information contained in the Privacy Policy and comply with the California Consumer Privacy Act of 2018, as amended, including by the California Privacy Rights Act of 2020 and its implementing regulations (referred to as "CCPA"). Any terms defined in the CCPA have the same meaning when used in this notice.

Personal Information Collected. We may collect, and have collected in the preceding twelve (12) months, the following categories of personal information:

  • Identifiers, such as first and last name, alias, postal address, telephone number, email address, unique personal identifier, online identifier, and IP address.
  • California Customer Records Information, such as name, contact information, physical characteristics, education, employment, and employment history. Some personal information in this category may overlap with other categories.
  • Protected Classification Characteristics Under California or Federal Law, such as age, race, color, national origin, citizenship, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), military and veteran status.
  • Commercial information, such as records of services purchased, obtained, or considered.
  • Internet or other similar network activity, such as information on your interaction with our website, application, or advertisement, cookies, log data.
  • Geolocation data, such as physical location or movements.
  • Sensory data, such as audio, electronic, visual, thermal, olfactory, or similar information.
  • Professional or employment-related information, such as current or past job history.
  • Non-public education information, which may include education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes, student financial information, or student disciplinary records.
  • Inferences drawn from other personal information, such as a profile reflecting a person's preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes.

Business Purposes and Disclosure. We may use or process each of the above categories of personal information for one or more of the purposes described in the "How We Use Your Personal Data" section above, which includes without limitation, (i) to operate, manage, maintain, develop, and improve our business and the Services; (ii) to provide the Services to you; (iii) to communicate with you; (iv) to analyze the use of our Services; (v) to personalize, advertise, and market the Services; (vi) for security; (vii) for legal compliance; and (viii) with your consent.

We may disclose, and have disclosed in the preceding twelve (12) months, each of the above categories of personal information for our operational business purposes to the parties described in the "How We May Share Personal Data We Collect" section.

Personal Information Shared. Except as set forth in this Privacy Policy, we do not sell the personal information we collect. We do not knowingly share the personal information of minors under sixteen (16) years of age.

Retention. We retain personal information for as long as reasonably necessary to provide you with the Services, to perform our legitimate business purposes, or for other essential purposes such as complying with our legal obligations, maintaining records, resolving disputes, maintaining security and preventing harm, detecting and preventing fraud and abuse, enforcing our agreements. The criteria used to determine retention periods includes the legal limitation of liability period, agreed contractual provisions, applicable regulatory requirements, and industry standards.

Consumer Rights and Requests. You may request that we disclose to you the following information as required by law:

  • The categories of personal information we collect about you and the categories of sources from which we collect such information;
  • The business or commercial purpose for collecting, selling, or sharing personal information about you;
  • The categories of personal information about you that we have sold or shared and the categories of third parties to whom we sold or shared such information; and
  • The categories of personal information about you that we otherwise disclosed, and the categories of third parties to whom we disclosed such personal information.

You may also request (i) to correct inaccuracies in your personal information; (ii) to receive a copy of your personal information; (iii) that we delete your personal information, subject to certain exceptions; or (iv) to "opt-out" of your personal information being shared with certain third parties, as described above.

Non-Discrimination. We will not unlawfully discriminate against you for exercising any of your CCPA rights.

Response to Requests. We will attempt to respond to California resident requests in as timely a fashion as possible. In the event of delays over forty-five (45) days, we will inform you of the reason and extension period in writing. Any disclosures we provide will only cover the twelve (12) month period preceding the verifiable receipt of a California Resident's request unless you request otherwise and that time period meets the regulatory requirements. The response we provide will explain the reasons we cannot comply with a request, if applicable.

Shine the Light. California residents are entitled to request and obtain from us once per calendar year certain information regarding our disclosure of personal information to third parties for their own direct marketing purposes. Handshake AI does not disclose personal information to third parties for their direct marketing purposes.
